General Conditions

in shopping at "Online shop BE UNIQUE for work uniforms, shoes, slippers, bed linen, towels and accessories" of "Bultex 99" LTD

 

Parties

Art. 1. These terms and conditions contain a framework contract for sale between "Bultex 99" Ltd, registered in the Commercial Register at the Plovdiv District Court judgment in the company file № 1073/2003, and hereinafter referred to as TRADER, on the one hand and the person who has expressed electronically in website http://beunique.bg under the terms of the purchase, hereinafter referred to as CLIENT from other.


Definitions

Art. 2. In the interpretation and application of these General Conditions the following terms and expressions have the following meanings: "Website" ("website") is a special place in the global Internet network, accessible through its unique address (URL) protocol HTTP, HTTPS or other standardized protocol and containing files, programs, text, sound, picture, image or other materials and resources. "Online Store BE UNIQUE for work uniforms, shoes, slippers, bed linen, towels and accessories" is a website for e-commerce merchant - a virtual information resource on the Internet for the sale and delivery of goods published in it.


Agreement

Art. 3. (1) Any person may use provided by the trader "Online shop BE UNIQUE for work uniforms, shoes, slippers, bed linen, towels and accessories" resources and services subject to these Terms.

(2) The publication of these Terms and the description and prices of goods in the "Online Store BE UNIQUE for work uniforms, shoes, slippers, bed linen, towels and accessories" is a public invitation within the meaning of Art. 290, para. 1 of the Commerce Act to make an application for purchase in accordance with them as described in the next paragraph way.

(3) By ticking the box "I agree with the terms" and press the virtual button "Order" The client makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, which declares that it is familiar with these Terms and agrees to buy his chosen products in their action. Art. 4. (1) Any extra application for purchase addressed by the Customer to the trader shall be considered separately agreed.

 (2) When false address and / or phone are out to the application for  purchase The trader has no obligation to perform the contract.

(3) It is assumed that any person who has paid the price stated by him to buy goods, has expressed a willingness to be bound by the text of these General Terms and Conditions.

       Publication of information on "Online Store BE UNIQUE for work uniforms, shoes, slippers, bed linen, towels and accessories"

Art. 5. (1) TRADER publish at http://beunique.bg short description and price for each of the goods that can be purchased through from "Online shop BE UNIQUE for work uniforms, shoes, slippers, bedding, towels and accessories ".

(2) TRADER is not liable for untruthfulness of that manufacturer's information for the product.

Prices at "Online Store BE UNIQUE for work uniforms, shoes, slippers, bed linen, towels and accessories" - prices are quoted in BGL, VAT included.

(3) The indicated prices of individual goods are for one or a single package and do not include delivery costs.

Art. 6. Delivery costs are formed based on the weight of the individual and paid to courier delivery.


Payment methods

Art. 7. (1) The price of art. 5 can be paid at any of the following ways:

- Cash to the courier;

- By bank transfer;

(2) Delivery is made after authorization of the transaction.


Rights and obligations of the parties

Art. 8. The products in the electronic catalog are updated based on availability, but some model, size or shade are not available. In the absence of stock of the declared goods within two working days of receipt of the purchase application, Associate of "BULTEX 99" LTD notify the Customer of its exhaustion by sending a message to the specified e-mail address of the Customer or on the phone.

Art. 9. "Bultex 99" Ltd is obliged:

- To transfer the ownership of the goods stated to purchase from the Customet;

- To deliver in time the stated purchase goods;

- To take due care to meet their obligations.

Art. 10. (1) The client is obliged:

- To indicate accurate and valid telephone and address for delivery;

- To pay the price of the goods;

- To pay the costs of delivery;

- To provide access and opportunity to receive the goods;

- To receive the item;

(2) The client follows:

- Not to submit fake requests or other information;

- To observe the Bulgarian legislation, applicable foreign laws, these Terms, Internet ethics, rules of morality and decency;

- Do not infringe someone else's property or moral rights;

- Do not impersonate another person or representative of a legal person or group of people who is not authorized to represent or otherwise mislead others about your identity or affiliation to a certain group of people;


Delivery

Art. 11. (1) The stated purchase is delivered to the address specified by the Client for delivery within 3 working days as total delivery time. If the same is not available in the warehouse of a merchant, the delivery time is 15-20 working days.

(2) The delivery under par. 1 run from the first working day after authorization of payment.

(3) The goods are delivered properly packed according to its type and mode of transport.


Delivery of goods

Art. 12. (1) The goods are delivered to the Client or other person within specified by the customer delivery address. Receiving person confirms with his signature receipt of goods on behalf of the Client.

(2) Upon delivery of the goods customer or the person under par. 1 sign the accompanying documents.

(3) In case of refusal the cases under Art. 13 para. 1, the refusal is considered groundless and the Customer due to the costs of returning the goods. In this case the customer is obliged to compensate "Bultex 99" LTD for any damages or lost profits, including any costs beyond the cost of delivery and return the goods occurred as a result of the refusal.

(4) In case the client is not found in time for shipment to the address or there is no access and conditions for delivery of goods in this period, "Bultex 99" Ltd is released from the obligation to deliver the purchased commodity. The customer can confirm their willingness to receive the goods after the expiry of delivery, which was not found at the address, assuming any additional shipping costs. In this case, begins a new period for delivery from the time of confirmation of the previous sentence.

Art. 13. (1) The client has the right to refuse to accept the stated purchase product when it is delivered in one of the following conditions:

1. The goods supplied do not correspond to the stated purchase by the Customer and this can be detected by an ordinary examination;

2. When transporting the product or its packaging is damaged.

(2) Failure to receive the goods under the preceding paragraph shall be inadmissible after the signing of the accompanying documents referred to in Art. 12, para. 2.

(3) Upon receipt of the goods the Customer is entitled to demand its return in a significant deficiency, which could not be detected in a simple review of the same.

(4) Subject to paragraph. 1, p. 1, and a discrepancy between the stated purchase and deliver, which was not possible to be established at the time of delivery, the Customer may request delivered goods to be replaced by corresponded made by him for purchase within one working day of receipt.

(5) The client has the right, without compensation, to abandon the contract within seven days from the day following receipt of the goods. In this case, the Customer must return the goods in the original packaging, intact and on its own account with the same forwarder.


Personal data

Art. 14. (1) "Bultex 99 Ltd" due care to protect the personal data of the Customer become known for filling the electronic form for making an application for purchase. This obligation shall cease, if the Customer has provided false data.

(2) Subject to applicable law and the provisions of these Terms, "Bultex 99" Ltd may use customers' personal data only for the purposes specified in the contract.

(3) "Bultex 99" Ltd. has the right to use the information under par. 1 for the supply of goods and / or services to customers, promotions, statistical and any other legitimate purpose, unless express disapproval of same sent to the following e-mail address: sales@beunique.bg.

 (4) The above-mentioned objectives, which can use the data are not exhaustive and do not create obligations of "Bultex 99" LTD. Any other purposes for which the data is used, will be tailored to the Bulgarian legislation, the applicable international instruments, Internet ethics, rules of morality and decency.


Disclosure

Art. 15. "Bultex99" Ltd. shall not disclose any personal information about the Customer to third parties - government authorities, companies, individuals and others, unless:

- Has obtained the express consent of the Client;

- The information is required by state authorities or officials, according to current legislation are entitled to demand and collect such information;

- "Bultex 99" Ltd is obliged to provide information under the law.


Termination of the contract

Art. 16. Apart from the above in these Terms cases, either party may terminate the individual contract by giving one week notice to the other party in the event of default under the contract.


Responsibility

Art. 17. "Bultex 99" Ltd is not responsible for failure to fulfill obligations under this Agreement upon the occurrence of circumstances beyond the control of "Bultex 99" Ltd. - cases of force majeure, fortuitous events, problems in the global network of the Internet and the provision of services beyond the control of "Bultex 99" LTD.


Benefits

Art. 18. The Client shall indemnify "Bultex 99" LTD and all third parties for damages and lost profits, including all costs and paid lawyer's fees incurred as a result of claims by and / or compensations paid to third parties the breach of his obligations under this contract, breach of Bulgarian legislation, applicable foreign laws, these Terms, morality or netiquette.


Arbitration

Art. 19. All disputes between the parties shall be resolved in a spirit of understanding and goodwill. If no agreement is reached, all outstanding disputes arising from the contract between the parties or relating to it, including disputes arising from or related to its interpretation, invalidity, performance or termination, as well as disputes about filling gaps in the contract or adaptation to new circumstances shall be settled by Arbitration Court at the BCCI, according to its Rules of cases based on arbitration agreements.


Writing

Art. 20. The written form shall be deemed to be observed by sending e-mail, pressing an electronic button on a page with content that is completed by the Customer or ticking a box (check box) in the website of "Bultex 99" Ltd. and others, similar as far as the statement is technically recorded in a way that allows it to be reproduced.


Invalidity

Art. 21. The Parties declare that in the event that any / and provision in these Terms is / to be invalid / and this will entail the nullity of the contract clauses or other parts. The invalid clause will be replaced by mandatory rules of law or practice.


Intellectual property rights

Art. 22. All intellectual property rights on the elements of the "Online Store BE UNIQUE for work uniforms, shoes, slippers, bed linen, towels and accessories" belong to "Bultex99" Ltd., including, but not limited to texts, graphics, computer programs, databases and more like.


Applicable law

Art. 22. All outstanding of these General Terms the provisions of the legislation of the Republic of Bulgaria.
